Privacy Policy

What we collect when you apply, how we use it, and who we share it with.

Effective date: August 14, 2026 · Last updated: August 25, 2026

This policy explains what information Berkley Financial Group LLC collects when you use berkleyfinancialgroup.com or apply for funding through us, how we use it, and who we share it with.

Berkley is an independent sales organization. We present applications to third-party funding partners; we do not make funding decisions ourselves. That shapes how your information moves, and this policy describes it plainly.

Berkley’s services are available only to businesses operating in the United States. This policy is written for United States law and is not intended for use outside the United States.

Information We Collect

Contact information. Your name, business name, title or role, mailing address, email address, and phone numbers, including mobile numbers.

Business information. Legal entity name and structure, industry, EIN, date the business started, number of locations, monthly and annual revenue, ownership details, and business documents such as formation documents and tax returns.

Financial and bank account information. Bank statements, account and routing numbers, deposit and transaction history, processing statements, existing obligations, and other financial records you provide or authorize us to retrieve.

Credit information. Business credit reports and scores, and consumer credit reports and scores for owners, officers, and guarantors, along with the personal identifiers needed to obtain them, which may include Social Security number and date of birth.

Information collected automatically. IP address, device and browser type, operating system, referring page, pages viewed, links clicked, time spent, approximate location derived from IP address, and similar technical data collected through cookies and related technologies.

How We Collect It

  • Directly from you, when you complete a form, submit an application, upload documents, email us, call us, or text us.
  • Automatically, through cookies, server logs, and similar technologies, which may include pixels and analytics tools.
  • From third parties, including credit reporting agencies, bank data and document verification providers, payment processors, public records and business databases, marketing partners and lead sources, and funding partners who report back on the status of your application.

If you reached us through a third-party lead source or referral partner, we receive the information that partner collected from you.

How We Use It

To evaluate whether your business appears eligible for funding; verify your identity and the information and documents you provide; prepare and submit your application to third-party funding partners; communicate with you about your application by phone, text, and email; coordinate between you and a funding partner through closing; respond to your questions and provide customer service; send you information about our services where permitted and subject to your choices; detect and prevent fraud and protect the security of our systems; improve our website and services; and comply with legal and regulatory obligations, including identity verification and recordkeeping requirements.

Who We Share It With

Information you provide is shared with third-party funding partners for the purpose of evaluating your application. We do not sell your personal information for money. We do share limited website activity with advertising partners so we can show and measure our ads, and you can opt out of that at any time.

Beyond funding partners, we share information with service providers who work on our behalf (hosting and cloud storage, CRM and communications platforms, document and bank data verification, analytics, and email and text delivery), who may use your information only to perform services for us; credit reporting agencies and verification services, in connection with the authorizations described in our Terms of Use; professional advisors such as our attorneys, accountants, and auditors; government authorities and other parties when required by law, subpoena, or court order, or when disclosure is necessary to protect our rights, investigate fraud, or protect the safety of any person; and a successor, if Berkley is involved in a merger, acquisition, financing, or sale of assets.

When your information reaches a funding partner, that partner handles it under its own privacy policy, which we do not control. Review the partner's policy before you sign its agreement.

SMS Consent Is Never Shared

We do not sell, share, transfer, or otherwise disclose SMS consent, or the mobile phone numbers collected for text messaging purposes, to any third party, affiliate, marketing partner, or lead buyer, for any purpose.

If you consent to receive text messages from Berkley Financial Group, that consent is used exclusively by Berkley Financial Group. No third party has the benefit of your consent, and no third party receives your mobile number or your opt-in status from us for its own marketing.

The only exception is the messaging platform and carriers we use to deliver our own messages to you. Those providers act on our behalf and may not use your number for any other purpose.

This applies regardless of any other sharing described elsewhere in this policy.

Cookies and Tracking

We use cookies and similar technologies, including pixels and tags, to operate the site, remember your preferences, understand how the site is used, and measure the performance of our advertising. They fall into three groups: necessary cookies, which make the site work; analytics cookies, which tell us how visitors find and use the site; and advertising cookies, which we and our advertising partners use to show you our ads on other sites and to measure whether those ads worked.

Most browsers let you refuse or delete cookies. If you block cookies, parts of the site may not work correctly. We honor Global Privacy Control and similar browser-based opt-out signals where required by law.

Advertising and the Meta Pixel

We advertise on Meta platforms, including Facebook and Instagram. To do that, this website uses the Meta Pixel and related Meta Business Tools.

When you visit berkleyfinancialgroup.com, the Meta Pixel may send Meta information such as your IP address, browser and device details, the pages you viewed, the buttons you clicked, and whether you started or submitted an application. Meta receives this information and uses it both to deliver and measure our advertising and for its own purposes under its own policies.

We do not send Meta, or any other advertising partner, your bank statements, account or routing numbers, Social Security number, credit report data, or the contents of your application.

Meta handles the information it receives under the Meta Privacy Policy. You can control the ads you see from us and from others in your Facebook or Instagram account under Ad Preferences.

We may use similar advertising and measurement technologies from other advertising partners for the same purposes. Where we do, the same limits apply: they receive website activity, not your financial or application data.

How to opt out of advertising tracking:

  • Global Privacy Control. Turn on GPC in your browser or a browser extension. We treat a GPC signal as an opt-out request for the browser that sends it.
  • Meta. Adjust Ad Preferences in your Facebook or Instagram account settings.
  • Industry opt-outs. Use the Digital Advertising Alliance at optout.aboutads.info or the Network Advertising Initiative at optout.networkadvertising.org.
  • Your browser. Block or delete cookies in your browser settings.
  • Contact us. Use any method under Do Not Sell or Share My Personal Information.

Do Not Sell or Share My Personal Information

We do not sell your personal information for money. We do share personal information for cross-context behavioral advertising, which is what California law calls “sharing.” That happens when advertising technologies on this site, including the Meta Pixel, pass information about your visit to advertising partners so we can show you relevant ads and measure them.

You have the right to opt out of that sharing at any time, and we will not treat you differently for exercising it. To opt out, use any of these:

  • Turn on Global Privacy Control in your browser. We honor it as an opt-out for that browser.
  • Email [email protected] with “Do Not Sell or Share” in the subject line.
  • Call 646-347-2825 and ask to opt out.

Opting out of advertising sharing does not stop us from contacting you about an application you have already started, and it does not affect the information we send to funding partners to evaluate that application.

Data Retention

We retain your information for as long as reasonably necessary for the purposes described in this policy, to comply with legal obligations, resolve disputes, and enforce agreements, and as otherwise permitted by law. The periods below are typical minimum periods, not maximums, and actual retention may be longer.

  • Application and transaction records: seven years
  • Records for applications that did not result in funding: two years
  • Consent records for calls and text messages: five years
  • Call recordings, if we record calls: two years
  • Website analytics data, if collected: 26 months

We may retain information that has been de-identified or aggregated, so that it no longer identifies you or your business, indefinitely, and we may use it for any lawful purpose.

Data Security

We use administrative, technical, and physical safeguards designed to protect your information, including encryption of data in transit, access controls limiting who at Berkley can see your records, and vendor agreements requiring our service providers to protect the information we share with them.

No system is completely secure. We cannot promise that unauthorized access will never occur. Please do not send sensitive documents, account numbers, or identification numbers by unsecured email or text. If a breach affecting your information occurs, we will notify you as required by applicable law.

Your Choices

Even if you opt out of marketing, we may still contact you about an active application or an existing transaction.

California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended, gives you the right to know what personal information we have collected about you, where we got it, why we collected it, and who we disclosed it to; the right to a copy of the specific personal information we hold; the right to delete it, subject to legal exceptions; the right to correct inaccurate information; the right to opt out of the sale or sharing of personal information (we do not sell your personal information for money, but we do share website activity for advertising, and you can opt out under Do Not Sell or Share My Personal Information); the right to limit the use of sensitive personal information; and the right not to be discriminated against for exercising these rights.

To make a request, email [email protected] or call 646-347-2825. We will verify your identity before responding, which may mean asking you to confirm information we already have. You may use an authorized agent, in which case we will ask for proof of authority. We will respond within 45 days, and may extend by another 45 days if we tell you why.

Other State Privacy Rights

Residents of other states with comprehensive privacy laws, including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and others as those laws take effect, may have similar rights to access, correct, delete, or obtain a copy of their personal information, to opt out of targeted advertising, and to appeal a denial.

To exercise these rights, including opting out of targeted advertising, email [email protected], call 646-347-2825, or use any method under Do Not Sell or Share My Personal Information. If we deny your request you may appeal by replying to our response, and we will respond within the period your state’s law allows.

Nevada residents may submit a request that we not sell certain personal information. Vermont residents: we will not share information about you with non-affiliated third parties for their own marketing purposes, except as permitted by law or with your authorization.

Children's Privacy

Our site and services are for businesses and are not directed to children. We do not knowingly collect personal information from anyone under 18. If we learn we have, we will delete it. If you believe a minor has given us information, contact us at [email protected].

Changing Your Information

You may ask us to update or correct the information we hold about you at any time by emailing [email protected] or calling 646-347-2825. Please keep your contact information current so we can reach you about your application.

Some information cannot be changed or deleted where we are required to keep it, for example records retained for legal, regulatory, audit, or fraud prevention purposes.

Changes to This Policy

We may update this policy from time to time. When we do, we will post the revised version here and update the "Last updated" date. Changes take effect when posted. Your continued use of the site after a revised policy is posted means you accept the revised policy. If the changes are material, we will provide additional notice as required by law.
