What we do, what we do not do, and the rules that apply when you use this site.
Effective date: August 14, 2026 · Last updated: August 14, 2026
This website, berkleyfinancialgroup.com, is operated by Berkley Financial Group LLC ("Berkley," "we," "us," or "our"). These Terms of Use govern your access to and use of the site, the forms and applications on it, and any related services we provide (together, the "Services").
Please read this page carefully. It explains what we do, what we do not do, and the rules that apply when you use our site.
By using this site, submitting an application or inquiry, or communicating with us through the site, you agree to these Terms of Use and to our Privacy Policy and SMS Terms, each of which is part of this agreement.
If you are using the Services on behalf of a business, you confirm you are authorized to accept these terms for that business, and "you" means both you personally and that business.
If you do not agree to these terms, do not use the site.
The Services are for business use only. To use them, you must:
The Services are not offered to consumers seeking personal credit and are not intended for anyone under 18.
When you use the Services, you agree not to:
We may suspend or terminate your access at any time if we believe you have violated these terms.
We may update these Terms of Use from time to time. When we do, we will post the revised version on this page and update the "Last updated" date. Changes take effect when posted. Your continued use of the site after that point means you accept the revised terms.
Berkley Financial Group LLC is not a funder. We do not provide, issue, or make credit or funding decisions.
Berkley is an independent sales organization, also called an ISO or broker. In practice that means:
Every decision belongs to the funding partner, not to us. Whether an application is approved or declined, the amount offered, the cost, the payment structure, the term, and every other condition are determined solely by the third-party funder that makes the offer. Berkley has no authority to approve an application, to commit a funding partner, or to set or change any term.
The funding arranged through Berkley is generally a purchase of a portion of your business's future receivables. It is not a loan, and it does not create a debt with Berkley. If a funding partner offers a different type of product, or if you are referred to a bank or an SBA lender, that transaction is between you and that third party, and its own documents and disclosures govern it.
We are not advisors. Berkley is not a financial advisor, an accountant, or a law firm. Nothing on this site or in any conversation with us is financial, tax, accounting, or legal advice. Everything on this site is general information only, and you agree not to rely on it as a substitute for advice from your own professionals. No fiduciary, advisory, or agency relationship is created between you and Berkley by your use of the site or the Services. We do not evaluate whether a transaction is suitable for your business. Consult your own attorney, accountant, or advisor before entering into any funding agreement.
We make no promises about outcomes. Berkley does not commit or guarantee that any review, submission, service, or guidance will result in an approval, an offer, funding, or any particular terms. Nothing we say, write, or send is a commitment to provide or arrange funding.
How we are paid. Berkley is compensated by commission paid to us by the funding partner when a transaction closes. Because our compensation comes from funding partners, and because different partners may pay different amounts, read every offer on its own merits and review all documents before you sign.
Review your funding agreement. Any agreement you enter into is between you and the funding partner. Read it in full. Its terms control that transaction, and they may differ from anything discussed with us.
By using the Services, you agree that we may provide agreements, notices, disclosures, and other communications to you electronically, by email or by posting them on the site, instead of on paper. You agree that electronic records and electronic signatures have the same legal effect as paper records and handwritten signatures.
To receive and keep electronic communications you need a device with internet access, a current web browser, an active email address, and the ability to view and save PDF files.
You may withdraw this consent at any time by contacting us at [email protected] or 646-347-2825. If you withdraw consent we may not be able to continue providing the Services to you. Withdrawal does not affect the validity of anything you agreed to electronically beforehand. You may request a paper copy of any electronic record by contacting us.
By submitting an application or inquiry, you authorize Berkley and the funding partners we present your application to, and their respective agents and service providers, to obtain and review:
You authorize this in connection with evaluating your application, verifying the information you provide, and reviewing your business for current and future funding opportunities.
This authorization continues until you revoke it in writing at [email protected]. Revoking it does not affect anything already done in reliance on it, and it may end our ability to work on your application.
By providing your phone number or email address, you agree that Berkley and the people working on your application may contact you at that number or address about your inquiry, your application, and our services.
You agree we may contact you by phone, including calls placed with an automatic telephone dialing system and including artificial, prerecorded, or AI-generated voice messages; by text message; and by email.
You do not have to agree to receive marketing calls or texts in order to use our services or to submit an application. Consent to marketing messages is not a condition of any purchase, of approval, or of receiving any service from us.
You agree we may contact you at the number you provide even if that number is on a federal or state Do Not Call list, and you confirm you are the subscriber or customary user of that number and are authorized to give this consent. If your number changes, tell us promptly.
You may withdraw consent to marketing calls at any time by emailing [email protected] or calling 646-347-2825. To stop text messages, see the SMS Terms. We may still contact you about an active application or an existing transaction after you opt out of marketing.
If you opt in to text messages from Berkley Financial Group, our full SMS Terms apply and are part of this agreement. In short:
We do not sell, share, transfer, or otherwise disclose SMS consent, or the mobile numbers collected for SMS purposes, to any third party. Your consent to receive text messages from Berkley Financial Group is used exclusively by Berkley Financial Group.
If you create an account or receive login credentials, you are responsible for keeping them confidential and for all activity under them. Do not share your credentials.
You agree to give us accurate and complete information and to keep it current. Submitting false or altered documents is grounds for immediate termination of access and may be reported to funding partners and to law enforcement.
Tell us right away at [email protected] if you believe your credentials or account have been compromised. We are not responsible for losses caused by someone else using your credentials, whether or not you authorized it.
You agree to use the Services in compliance with all applicable federal, state, and local laws. You confirm that your business is operating lawfully, that the information you provide is truthful, and that any funding you obtain will be used for lawful business purposes.
We may be required to verify your identity and the identity of your business under applicable anti-money-laundering and customer identification rules, and to report certain activity to government authorities. We may decline to work with any business or individual at our discretion.
The site and everything on it, including text, graphics, logos, layout, images, and software, are owned by Berkley or its licensors and are protected by copyright, trademark, and other laws. "Berkley Financial Group" and our logo are our marks and may not be used without our written permission.
You may view and print pages from the site for your own business use in evaluating our services. You may not copy, reproduce, modify, distribute, publish, or create derivative works from the site or its content for any other purpose without our written permission.
Any feedback or suggestions you send us may be used by us freely, without obligation or compensation to you.
The site may contain links to, or integrate with, websites, tools, and services operated by third parties, including the websites and application portals of funding partners. Those sites and services are governed by their own terms and privacy policies, not by these Terms of Use.
We do not control third-party sites or services, we do not endorse them by linking to them, and we are not responsible for their content, accuracy, availability, security, or practices, or for any loss arising from your use of them. Your dealings with any third party, including any funding partner, are solely between you and that third party.
The site and the Services are provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the site will be uninterrupted, secure, error-free, or free of viruses, or that any information on it is accurate, complete, or current. Information on this site is general and may not apply to your situation.
We make no warranty or representation about any third-party funding partner, about any offer you receive, or about the terms, performance, or conduct of any third party. We do not endorse any funding partner, and we are not responsible for their acts or omissions.
To the fullest extent permitted by law, Berkley and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, or lost data, arising out of or relating to the site, the Services, or any transaction with a funding partner, even if we have been advised that such damages are possible.
To the fullest extent permitted by law, our total liability for all claims relating to the site or the Services will not exceed one hundred dollars ($100).
Some states do not allow certain limitations of liability, so parts of this section may not apply to you.
You agree to defend, indemnify, and hold harmless Berkley and its members, officers, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the site or the Services; information or documents you submit, including anything false, inaccurate, or altered; your breach of these Terms of Use or of any law; or any dispute between you and a funding partner or other third party.
We may take over the defense of any matter subject to indemnification, at your expense, and you agree to cooperate with us.
Before starting any formal proceeding, you agree to contact us at [email protected] with a written description of the dispute and the relief you are seeking, and to give us 30 days to try to resolve it informally. We will do the same before bringing a claim against you.
Any dispute arising out of or relating to these Terms, the site, or the Services that is not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its rules, rather than in court. The arbitration will be held in New York County, New York before a single arbitrator, and judgment on the award may be entered in any court of competent jurisdiction. You and Berkley each waive the right to a jury trial, and each agree that claims may be brought only in an individual capacity, not as a plaintiff or class member in any class, consolidated, or representative proceeding. Either party may instead bring an individual claim in small claims court.
These Terms of Use and any dispute arising out of or relating to them, the site, or the Services are governed by the laws of the State of New York, without regard to its conflict of laws rules.
Subject to the Dispute Resolution section above, any action must be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts and waive any objection based on venue or inconvenient forum.
To the fullest extent permitted by law, any claim arising out of or relating to these Terms, the site, or the Services must be brought within one (1) year after the claim accrues. Any claim not brought within that period is permanently barred.
If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions stay in full force. Our failure to enforce any provision is not a waiver of our right to enforce it later, and any waiver must be in writing to be effective.
Any provision that by its nature should survive termination of these terms or of your use of the Services will survive, including the intellectual property, disclaimer of warranties, limitation of liability, indemnity, dispute resolution, governing law, and time to bring claims provisions.
These Terms of Use, together with our Privacy Policy and SMS Terms, are the entire agreement between you and Berkley regarding the site and the Services, and they replace any earlier understandings on that subject.
These terms do not govern any funding agreement you enter into with a third-party funding partner. That agreement is separate and its own terms control.
You may not assign or transfer these terms or any rights under them without our prior written consent, and any attempted assignment without consent is void. We may freely assign or transfer these terms and our rights and obligations under them, including in connection with a merger, acquisition, reorganization, or sale of assets.
